View Full Version : What to File after Divorce???
youbetcha1018
Hi all. I have a friend who wants to file a divorce against her husband for some really bad reasons. Now, they both bought properties using their individual savings. Now, my friend doesn't know what to file after divorce? She wants her shares back. Thanks in advance.

What to file for what?
For taxes, if she's divorced before the end of the year, she files as single, because she's single.
If you're asking how she gets some kind of money or "shares" she gave the husband or whatever, she needs to get all that hammered out in the divorce agreement. She can't do one.single.thing after it's all over.

Wchua24,
Annulment is retoracive, it is as though the marrige never happened. Grounds for annulment generally are limited to - fraud, bigamy and mental incompetance.
Divorce will always recognize the marrige did exist, and is supposed to define the sharing of the results of the marriage.

My friend doesn't have any idea about divorce, neither do I. She just told us that she wants to leave her husband and would like to get her shares back. A month after they got married, she bought a car for them to use, using her own savings. Then they bought their own house, using 50% of my friends savings and 50% of her husband's savings. Whenever, they buy something or anything it is always have to contribute 50-50. Now, she's thinking if she will file a divorce will she get her 50% share from what they own now? Thanks much

YouBetcha,
Divorce can be a long and painful process. There's not much likelihood she will get what's hers TODAY. There are also legal processes that can make getting her share difficult (such as leaving the home she owns with him, in some instances, and in some states). She needs to hire a lawyer, so that she doesn't accidentally sign away her rights, or otherwise ruin her chances of getting what's hers.
The lawyer will tell her what to do. She needs to hire a divorce lawyer IMMEDIATELY.
