Lease Rental
Someone had asked me the other day what the standard eviction process looked like, and I thought I'd repeat it here for the benefit of both landlords and tenants:
Step 1. Tenant violates the lease agreement (e.g. doesn't pay rent, has 9 people living in a 2 bedroom house, etc)
Step 2: Landlord serves Tenant with state-specific eviction forms, giving Tenant a certain number of days to cure the lease agreement violation
Step 3: If Tenant fails to cure by end of the cure period, Landlord files for eviction in rent court
Step 4: Eviction hearing in rent court, both sides have chance to state case
Step 5: If judge rules in favor of Landlord, case is referred to sheriff's office
Step 6: Sheriff schedules a put-out date, at which time Landlord and Sheriff may enter Property, remove any leftover Tenant's belongings, and change locks.
It's not a fun process for anyone, and is expensive and time-consuming for the landlord.
