View Full Version : F1 visa - Social Security and Medicare tax

I have been in the USA for more than 7 years on H1 visa which makes me eligible to file my taxes as a permanent resident (1040 instead of 1040NR).

My wife is here with me but she is on student F-1 visa. She is going to school full time. During 2009 she worked on-campus and off-campus (summer). Because she is on F1, her employer did not deduct any social security or medicare taxes from her paychecks. Because if she were to file her own taxes she will be filing 1040NR and will be exempt from these taxes as long as she is on F1.

Now because we will be filing taxes together, do we need to pay those taxes in our tax return??
